This Subscription Terms & Membership Agreement ("Agreement") governs participation in the South Cut Hat Co. subscription program. By enrolling in a subscription, joining the waitlist, or participating in any membership offering provided by South Cut Hat Co. ("South Cut Hat Co.," "Company," "we," "our," or "us"), you agree to be bound by these terms.
Please read this Agreement carefully before enrolling in any subscription program.
Subscription Program Overview
South Cut Hat Co. offers a limited-capacity hat subscription program designed to provide members with exclusive hats and related membership benefits.
Subscription availability is intentionally limited to maintain product quality, fulfillment efficiency, and member experience.
Membership spots may be capped each month and are offered on a first-come, first-served basis unless otherwise stated.
Participation in the subscription program is subject to these Subscription Terms, our Terms & Conditions, and our Privacy Policy.
Membership Eligibility
To participate in the subscription program, you must:
- Be at least 18 years of age.
- Provide accurate billing and contact information.
- Maintain a valid payment method.
- Comply with all South Cut Hat Co. policies and agreements.
We reserve the right to deny, suspend, or terminate membership at our discretion if these requirements are not met.
Subscription Availability
Subscription memberships are limited.
South Cut Hat Co. may establish monthly membership caps based on:
- Production capacity
- Inventory availability
- Operational requirements
- Product demand
- Fulfillment capabilities
Initial membership availability may be limited to approximately 150 subscribers, though membership limits may increase, decrease, or change at any time.
Subscription availability is never guaranteed.
Waitlist Program
When subscription capacity is reached, prospective members may join a waitlist.
The waitlist is used to:
- Measure customer demand
- Notify customers of available openings
- Plan future subscription growth
- Improve inventory forecasting
Joining the waitlist does not guarantee:
- Acceptance into the subscription program
- A specific enrollment date
- Priority placement beyond the order determined by South Cut Hat Co.
- Future availability
We reserve the right to modify, pause, remove, or discontinue the waitlist program at any time without notice.
Subscription Billing
By enrolling in a subscription, you authorize South Cut Hat Co. and its payment processing partners to charge your selected payment method for recurring subscription fees.
Subscription fees will be charged according to the billing cycle presented during enrollment.
Charges may include:
- Subscription fees
- Applicable taxes
- Shipping fees, if applicable
- Other disclosed charges
You are responsible for maintaining accurate payment information at all times.
Failure to maintain a valid payment method may result in suspension or cancellation of membership benefits.
Automatic Renewal
Unless canceled in accordance with these terms, subscriptions automatically renew at the conclusion of each billing cycle.
By enrolling, you expressly authorize recurring charges to your designated payment method until cancellation occurs.
Renewal charges will continue automatically unless you cancel before the next billing date.
Pricing Changes
South Cut Hat Co. reserves the right to modify subscription pricing at any time.
If pricing changes occur, subscribers will be provided reasonable notice before the new pricing becomes effective.
Continued participation in the subscription program after pricing changes take effect constitutes acceptance of the revised pricing.
Subscription Benefits
Membership benefits may include:
- Exclusive hat releases
- Limited-edition products
- Subscriber-only merchandise
- Early access opportunities
- Membership communications
- Additional promotional benefits
Benefits may vary over time and are not guaranteed.
South Cut Hat Co. reserves the right to add, remove, modify, or discontinue membership benefits at any time.
Product Availability
While South Cut Hat Co. strives to provide consistent subscription products, availability may occasionally be affected by:
- Supplier issues
- Manufacturing delays
- Inventory shortages
- Shipping disruptions
- Circumstances beyond our control
We reserve the right to substitute products of comparable value when necessary.
Such substitutions do not constitute grounds for cancellation, refund, or compensation.
Shipping and Delivery
Subscription products will be shipped to the address provided by the subscriber.
Subscribers are responsible for:
- Providing accurate shipping information
- Updating address changes promptly
- Monitoring shipment delivery
South Cut Hat Co. is not responsible for delays caused by:
- Shipping carriers
- Weather conditions
- Customs processing
- Incorrect addresses
- Events beyond our reasonable control
Delivery dates are estimates only and are not guaranteed.
Subscription Cancellation
Subscribers may cancel their membership at any time.
Cancellation requests must be submitted before the next billing cycle to avoid future charges.
Once a billing cycle has begun and payment has been processed, that cycle's subscription is considered active and may not be eligible for cancellation or refund.
Cancellation will stop future recurring charges but will not affect benefits already paid for during the current billing period.
Refund Policy for Subscriptions
Due to the limited-capacity nature of our subscription program and inventory planning requirements:
- Subscription fees are generally non-refundable.
- Partial-month refunds are not provided.
- Missed subscription deliveries resulting from inaccurate customer information may not qualify for refunds.
Refund requests may be reviewed on a case-by-case basis at the sole discretion of South Cut Hat Co.
Nothing in this section limits any rights that cannot be waived under applicable law.
Membership Suspension or Termination
South Cut Hat Co. reserves the right to suspend, restrict, or terminate any membership if:
- Fraudulent activity is suspected.
- Payment failures occur.
- Customer information is inaccurate.
- These terms are violated.
- Conduct is deemed harmful to the Company or its customers.
Termination may occur without prior notice when necessary to protect the Company, its customers, or its operations.
No Transfer of Membership
Subscription memberships are personal and non-transferable.
Memberships may not be sold, assigned, transferred, sublicensed, or otherwise conveyed to another person without prior written consent from South Cut Hat Co.
Disclaimer
The subscription program is provided on an "as available" basis.
South Cut Hat Co. makes no guarantee regarding:
- Specific product designs
- Product availability
- Subscriber demand
- Waitlist movement
- Future subscription openings
- Membership growth projections
Actual results and availability may vary.
Limitation of Liability
To the fullest extent permitted by law, South Cut Hat Co.'s liability relating to subscription services shall not exceed the amount paid by the subscriber during the twelve (12) months immediately preceding any claim.
South Cut Hat Co. shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from participation in the subscription program.
Modifications to This Agreement
South Cut Hat Co. reserves the right to update or modify these Subscription Terms at any time.
Changes become effective upon posting to the website unless otherwise stated.
Continued participation in the subscription program following any update constitutes acceptance of the revised Agreement.
